Einführung in das Fotorecht

Abstract

Als Teil der Medienrechtsvorlesung im zweiten Semester des Bachelorstudiengangs Medien und Information der HAW Hamburg lernen die Studierenden, welche rechtlichen Rahmenbedingungen für die Aufnahme und Veröffentlichung von Fotografien zu beachten sind. Die Einführung in das Fotorecht ist für juristische Laien konzipiert und gibt im ersten Teil zunächst eine Übersicht über die vielfältigen Rechtsbeziehungen und unterschiedlichen gesetzlichen Grundlagen, die bei Bildpublikationen in Deutschland eine Rolle spielen. Im zweiten Teil wird die Frage thematisiert, an welchen Orten fotografiert werden darf, und insbesondere auf das Thema Hausrecht und Panoramafreiheit eingegangen.

As part of the second term course Media Law in the bachelor’s degree program Media and Information at the HAW Hamburg, the students learn which legal regulations for taking and publishing pictures have to be considered. This introduction to photo rights is aimed at legal lays. The first part gives an overview over the multifaceted legal relations and the different legal principles that are relevant for the publication of pictures in Germany. Part two explains at which places pictures can be taken with special regard to the “Sanctity of home” and the “Freedom of panorama”.
